ALLEGATION(S): Licensee is operating beyond the scope of the license. Licensee is operating over capacity. INVESTIGATION FINDINGS: On March 14th, 2023 at approximately 1:25pm, Licensing Program Analyst (LPA) Tapia-Mandujano conducted an unannounced, complaint investigation and met with licensee, Angelica Sorto regarding above allegations and explained the purpose of the visit. LPA and licensee toured the home for health and safety hazards. Complaint was received by the Department on 01/05/23. Present in the facility are licensee and assistant caring for 5 children (2 infant and 3 preschool age). All adults working or living in the facility have fingerprint clearance and are associated. During the course of the investigation, interviews were conducted with licensee, parents, involved parties, and relevant documents were gathered. LPA did not observe licensee operating beyond the scope of the license and/or licensee operating over capacity. Although the allegation above may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the above allegations are UNSUBSTANTIATED. After today’s visit, an exit interview was conducted with licensee, Angelica Sorto. A copy of this report was reviewed and provided to licensee. Upon receipt of this report, Licensee shall post the Notice of Site Visit. The report and the Notice of Site Visit shall be posted for 30 consecutive days. INVESTIGATION FINDINGS: On August 18th, 2022 at approximately 12:45pm, Licensing Program Analyst (LPA) Tapia-Mandujano conducted an unannounced, complaint investigation and met with licensee, Angelica Sorto regarding above allegation and explained the purpose of the visit. LPA and licensee toured the home for health and safety hazards. Complaint was received by the Department on 07/01/22. Present in the facility are licensee and assitant caring for 5 children (1 infant and 4 preschool age). All adults in the facility have fingerprint clearance. During the course of the investigation, interviews were conducted with licensee, parents, children, and relevant documents were gathered. Through inspection to the facility, LPA did not observe licensee hit day care children. Although the allegation above may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the above allegations are UNSUBSTANTIATED. ALLEGATION(S): Licensee administered another child's medication to a child in care. INVESTIGATION FINDINGS: On July 7, 2022 at approximately 9:30am, Licensing Program Analyst (LPA) Tapia-Mandujano conducted an unannounced 10- day complaint inspection in response to the above allegations. LPA met with licensee, Angelica Sorto, and explained the purpose of the visit. Present during inspection included licensee and licensee's assistant caring for 6 children (1 infant, 3 preschoolers, and 2 school age). During the investigation complaint that was received by department on 6/20/22, LPA substantiated the above allegation and deficiency was cited on 6/27/22. During that investigation, it was determined that with verbal consent of parent, cough syrup was administered to C2. Refer to 9099 and 9099D dated 6/27/22 for more details. ALLEGATION(S): Day care child was forced to ingest an unknown substance while in care. Staff forced their fingers down the throat of a day care child while in care, causing injuries. INVESTIGATION FINDINGS: On June 27, 2022 at approximately 11am, Licensing Program Analyst (LPA) Tapia-Mandujano conducted an unannounced 10- day complaint inspection in response to the above allegations. LPA met with licensee, Angelica Sorto, and explained the purpose of the visit. Present during inspection included licensee and licensee's assistant caring for 4 children (3 preschoolers and 1 school age). During today’s visit, LPA conducted a health and safety inspection, interviewed licensee, obtained copies of children and staff records, incident reports, and obtained other pertinent information. During interview with licensee, licensee stated that C2 and his sibling came to the facility with a cough. Per licensee, P3 brought to the facility honey syrup on 6/15 for licensee to administer. Per licensee, P3 gave verbal consent to administer honey syrup to C2 and C3. Licensee stated that on 6/16 when she was administering the honey syrup to C2, C2 started to gag and throw up after ingesting the honey syrup. Per licensee, C2 had phlegm stuck in his throat and to help assist C2 to clear his throat, licensee put her one finger in C2’s mouth. Continued on Page 2... Substantiated Estimated Days of Completion:
