This requirement was not met as evidenced by: Based on LPA’s interviews, the Licensee did not comply with the above by leaving a child unsupervised in the facility’s outdoor play area. This posed a potential risk to the health, safety, or personal rights of persons in care.

101223(a)(7) Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (7) Not to be placed in any restraining device... This requirement was not met as evidenced by: Based on interviews and observations made children are placed in high chairs while not actively eating for extended times as well as the facility uses the chairs for activities (arts and crafts projects) other than feeding. This poses a potential health and safety risk to children in care.

ALLEGATION(S): Facility staff inappropriately touched a child in care INVESTIGATION FINDINGS: Licensing Program Analyst (LPA) Medrano conducted an unannounced subsequent complaint inspection to discuss the above allegation and met with licensee, N.S. During the course of the investigation, IB Investigator James Santos conducted interviews with Staff, Guardians, Children, and obtained other supportive information. Although the allegation of staff in facility inappropriately touched child in care may have happened or may be valid, based on the information obtained by IB Investigator Santos, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is found to be “unsubstantiated.” Exit interview conducted and a copy of this report and appeal rights were reviewed and provided to Licensee, N.S. HSC 1597.16(a)(1) · Type B

(1) A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above as there is no water testing has been done in the facility by January 2023 and there is no waiver approved to waive getting tested which poses a potential health, safety or personal rights risk to persons in care.
