Unsubstantiated

ALLEGATION(S): Staff do not remove choking hazards. INVESTIGATION FINDINGS: On 02/15/2026 at 2:15pm, Licensing Program Analyst (LPA) Christina Uribe conducted an unannounced Complaint Investigation Visit for the above allegation of a personal rights violation. LPA met with site director, J.G. Also present at the time of today’s visit is 10 staff and 38 day care children in 3 classrooms. This agency has investigated the complaint allegation that the staff do not remove choking hazards. During the course of the investigation, LPA Uribe conducted interviews and made observations within the facility. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation did or did not occur, therefore the allegation is unsubstantiated. 101212(d) Reporting Requirements (d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This requirement was not met as evidenced by: Based on record review and interviews with staff that facility did not ensure that a call was made within 24 hours of the incident. As well as facility did not notify OSRO about installation of fences. This poses a potential health and safety risk to children in care.

101238(g) Building and Grounds (g)Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. This requirement was not met as evidenced by: Based on interviews, on 4/25/2025, a plastic water bottle filled with alcohol was found on a middle shelf in an unlocked cabinet. When it was found it was removed from the classroom, and confirmed by MVPD that it was alcohol. This poses a potential health and safety risk to children in care.

CCR 101416.5(b) · Type B

Staff-Infant Ratio. There shall be a ratio of one teacher for every four infants in attendance. This requirement is not being met as evidence by: Although most children were napping, some children were observed to be up and walking around in the classroom. During this time there were 22 infant aged children present with 2 staff members. This has the potential to be a health and safety risk to children in care.
