ALLEGATION(S): Adults hit a daycare child while in care INVESTIGATION FINDINGS: On June 10th, 2026 at approximately 9:40am, Licensing Program Analysts (LPA) Tapia-Mandujano conducted an unannounced inspection to conclude the pending complaint investigation. LPA was allowed entry by assistant, Eliane Soares dos Santos Vital. LPA explained the purpose of the visit to assistant. Present upon arrival were three assistants caring and supervising 9 children (3 infants and 6 preschoolers). Licensee, Neidemar Melazzo arrived later during inspection. All adults working at the facility have fingerprint clearance and are associated to the facility. During today’s inspection, LPA interviewed licensee and three assistants, as well as toured the facility for health and safety hazards. LPA also obtained an updated copy of the children’s roster. Complaint was received by the Department on April 2, 2026. During the course of the investigation, interviews were conducted with assistants, parents, and involved parties. (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement is not met as evidenced by: At 10:00AM., Based on Record Review, LPA confirmed staff's proof of mandated reporter training (AB1207) missing from 2 of 3 facility records. This poses a potential risk to the health and safety of children in care.
Documentation shall be maintained in the infant’s file and be available to the Department for review. Documentation shall include the following: Time of each 15-minute check This requirement is not met as evidenced by: At 10:55AM., Based on record review and interview, LPA confirmed licensee not maintaining proof of 15 minute review during infant nap. This poses a potential risk to the health and safety of children in care.

This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above, no staff present have their Madated Reporter Certification which poses a potential health, safety or personal rights risk to persons in care.
(d) For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home, including children under age 10 who reside at the licensee's home and the assistant provider's children under age 10, shall be either: (2) More than twelve and up to fourteen children only if the criteria in Section 1597.465 of the Health and Safety Code are met. This requirement is not met as evidenced by: At 2:20PM., Based on record review, interviews, LPA confirmed licensee is over capacity stated on license with four infants (13 children) in care. This poses an immediate health and safety risk to children in care.
(d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department or This requirement is not met as evidenced by: At 2:40PM., Based on record review and interview, LPA confirmed employee present, S1, without proper fingerprint clearance on file. This poses a potential health and safety risk to children in care.
