ALLEGATION(S): Licensee does not live at the family childcare home INVESTIGATION FINDINGS: On 11/07/2025, Licensing Program Analyst (LPA) Pedro Solorio-Gutierrez met with licensee Jouse Novoa Duque to deliver findings. LPA explained the nature of the visit. Present were licensee, assistants Miryan Fahisury Garcon Davila and Shannon (Natalia) Mendez, and 11 daycare children - three infants, seven preschool age, one school age. Based on observations and interviews conducted, although the allegation of licensee, Josue Novoa Duque, does not live at the family childcare home may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED. No deficiencies cited during visit. Exit interview was conducted and the report was reviewed with the licensee Jouse Novoa Duque. Appeal rights was handed to the licensee. ALLEGATION(S): Licensee does not reside at he daycare INVESTIGATION FINDINGS: On 07/25/2025, Licensing Program Manager (LPM) met with licensee Josue Novoa Duque assistant Shannon (Natalia) Mendez Garzon to deliver findings for above allegation. LPM explained the nature of the visit. Present were assistant, nine day care children including one infant and license's children ages 11 and 12 years old. LPM observed one infant leave upon arrival. Another assistant Ingrid Tumay arrived within five minutes through the front door and licensee arrived through a back door during visit. Based on observation, interviews conducted and pertinent documentation, although the allegation of licensee Josue Novoa Duque not living in the home may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED. No deficiency was cited. Notice of site visit was issued and must be posted for 30 days. Unsubstantiated Estimated Days of Completion:
If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). This requirement was not met as evidenced by Licensee's assistant Shannon (Natalia) Mendez Garzon stated during the visit she was alone with the 10 children while the other assistant took her lunch away from the facility. This poses an immediate risk to the Health, Safety or Personal Rights to children in care.
All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. This requirement was not met as evidenced by LPM observed a bucket of water with 7 1/2 inches of water accessible to children in the play area of the backyard. This poses an immediate risk to the Health, Safety or Personal Rights to children in care.
Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children. This requirement was not met as evidenced by LPM observed a gallon of carpet cleaning detergent in the back yard near the bucket of water along with sun block lotion on a counter in the day care area accessible to children. This poses an immediate risk to the Health, Safety or Personal Rights to children in care.
The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This requirement was not met as evidenced by LPM conducted interviews and obtained information that licensee Josue Novoa Duque had not been present during today's business hours. This poses a potential risk Health, Safety Personal Rights risk to children in care.
There shall be one crib or play yard for each infant who is unable to climb out of the crib or play yard. This requirement was not met as evidenced by LPA observed one infant sleeping on a mat. LPA asked if child was able to climb out of play pen. Licensee's assistant stated no. This poses a potential risk Health, Safety Personal Rights risk to children in care.
The provider shall place infants up to 12 month of age on their backs for sleeping. This requirement was not met as evidenced by LPA observed one infant less than one year sleeping on their tummy. LPA did not observed an Individual Infant Sleep Plan (LIC9227) completed in infant's file. This poses a potential risk Health, Safety Personal Rights risk to children in care.
(g) The licensee shall document each child's immunizations as required by the California Code of Regulations, Title 17, Section 6070, and shall maintain such documentation for as long as the child is enrolled. (1) This requirement includes updating each child's PM 286 (6/95) when the child is due to receive required immunizations after enrollment in the family day care home. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above. Child 1, 2 and 7 immunization records need to be updated which poses/posed a potential health, safety or personal rights risk to persons in care.
(8) Each family child care home shall have a current roster of children as specified in Health and Safety Code Section 1596.841. This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above. LPA observed child 5 was missing from roster which poses/posed a potential health, safety or personal rights risk to persons in care.
(d) At the time of acceptance of each child into care, the licensee shall provide the child's parent or authorized representative with a copy of the notice Family Child Care Home Notification of Parent's Rights, LIC 995A (8/06), the Caregiver Background Check Process, LIC 995E (6/05), and the Family child Care Consumer Awareness Information, LIC 9212 (10/05). (1) The licensee shall request the child's parent or authorized representative to sign and date the bottom portion of the notice form LIC 995A (8/06), which acknowledges that the parent or authorized representative has received and read the LIC 995A. The bottom portion of this form must be kept in the child’s file as proof that the parent or authorized representative has been notified of his or her rights and received a copy of the Caregiver background Check Process, LIC 995E (6/05), and the Family Child Care Consumer Awareness Information, LIC 9212 (10/05). This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above. Child 1 is missing LIC995 which poses/posed a potential health, safety or personal rights risk to persons in care.
(3) A file of affidavits signed by each parent with a child enrolled in the home. The affidavit shall state that the parent has been informed that the family child care home does not carry liability insurance or a bond according to standards established by the state. This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above. Child 1 is missing LIC282 which poses/posed a potential health, safety or personal rights risk to persons in care.
Documentation shall be maintained in the infant’s file and be available to the Department for review. LPA observed Safe Sleep logs are not completed and children are not being checked on at 15 minute mark which poses/posed a potential health, safety or personal rights risk to persons in care.
